1. Nature of the Services
From Fog to Fire is a coaching, education, and community brand. The Services include digital products, written content, recorded materials, group coaching programs, and a community. The Services are not therapy, counseling, psychotherapy, psychological care, medical care, nursing care, or any other form of clinical treatment.
Alexis Andrews is a registered nurse, and her clinical background informs how she coaches. In the context of From Fog to Fire, however, she operates as a coach and educator, not as a nurse providing clinical care to individual patients. Purchasing a product, joining a program, or participating in the community does not establish a clinical relationship between you and Alexis Andrews, From Fog To Fire Inc., or any of its representatives.
The Services are not a substitute for professional medical, psychiatric, psychological, nursing, or other licensed clinical care. You are solely responsible for your own health and well-being and for working with appropriately licensed professionals for any condition that requires clinical evaluation or treatment.
2. No medical advice; crisis resources
Information provided through the Site or the Services is general educational information and is not medical advice. You should always consult a qualified, licensed healthcare professional for any concerns about your physical or psychological health and before making any change to medication, treatment plan, or care arrangement.
The Services are not a crisis service and are not monitored as one. If you are in crisis or believe you may harm yourself or someone else, contact emergency services immediately. In the United States, call or text the 988 Suicide & Crisis Lifeline. For perinatal-specific support, Postpartum Support International can be reached at 1-800-944-4773 or by texting “HELP” to 800-944-4773. Outside the United States, contact your local emergency services or crisis line.
3. Eligibility
The Services are intended for adults aged 18 years or older. By using the Site or the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an entity, you represent that you are authorized to bind that entity to these Terms.
4. Accounts and registration
Some Services require an account. You agree to provide accurate, current, and complete information at registration and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized access. We may suspend or terminate accounts that violate these Terms.
5. Purchases, pricing, and payments
Prices, taxes, and any fees are presented at checkout. Payment is processed by our third-party payment processor (Stripe). By submitting payment information, you authorize us and our payment processor to charge the payment method you provide. You are responsible for any taxes, duties, or charges associated with your purchase that are not included at checkout. If a payment fails, we may suspend access until payment is resolved.
We may correct pricing errors and reserve the right to refuse or cancel orders affected by such errors. Where a payment plan is offered, you authorize the scheduled charges through completion of the plan; failure to pay an installment may result in suspension of access.
6. Refunds
Our refund terms are set out in the Refund Policy, which forms part of these Terms. Please review it before purchasing.

Any testimonials, case studies, or results presented through the Site or the Services reflect the experience of specific individuals at specific points in time. Individual results vary, and no specific result is guaranteed. Your experience will depend on many factors, including your circumstances, your engagement with the program, and the clinical care you receive (or choose to receive) outside the program.

THE SITE AND THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. WE MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. NO ADVICE OR INFORMATION OBTAINED FROM US OR THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
WITHOUT LIMITING THE FOREGOING, WE MAKE NO REPRESENTATION OR WARRANTY THAT THE SERVICES WILL DIAGNOSE, TREAT, CURE, OR PREVENT ANY MEDICAL OR PSYCHOLOGICAL CONDITION. THE SERVICES ARE EDUCATION AND COACHING AND ARE NOT A SUBSTITUTE FOR LICENSED CLINICAL CARE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL From Fog To Fire Inc., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

15. Termination
We may suspend or terminate your access to the Services at any time, with or without cause and with or without notice. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
16. Governing law and dispute resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Services will be resolved exclusively in the state or federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts.
